Americas & Caribbean

Many of the cases in which members have been involved in the Americas have been for oil industry clients in a variety of different regions including Alaska, Texas, Uruguay, Colombia, and a number of Caribbean Islands that enjoy the benefit of significant oil and gas resources off their coasts.

These disputes frequently concern the design or construction of extraction, refining or transportation facilities but members are also instructed in broader commercial disputes such as a recent LCIA arbitration concerning oil supply and storage contracts.

In addition to energy disputes, members have been instructed in a range of other matters, such as:

  • a Nassau arbitration concerning the construction of a luxury private residence in the Bahamas under Bahamian Law;
  • advisory work on a sale of goods dispute under Cayman law involving the sale of scrap metal in a contract between a Hong Kong and Cayman company;
  • appearing in the Supreme Court of Bahamas, acting for Bahamian and Turks & Caicos contractors seeking to enforce an AAA arbitrators’ award (seat Miami); and
  • resisting a challenge to the award validity in the Courts of the Turks & Caicos Islands.

Members have also been involved in public enquiry work, most notably the Commission set up by the Government of Trinidad & Tobago in 2009 in relation to public sector construction projects, procurement practices and methods of operation which included serious allegations of misconduct by officials.
