Max Twivy has a busy practice covering all areas of Chambers’ work, include construction, engineering, professional negligence, energy and utilities, and infrastructure.
Max also has significant experience in insolvency work and a range of general commercial disputes. Clients have described Max as “a name to watch for the future”, “extremely detailed, sharp and engaged”, “very intelligent and knowledgeable”, a “very clear communicator”, and “responsive and very pleasant to work with”. The judgment in Grove v Bagshot [2025] EWHC 591 (TCC) stated that “Mr Twivy’s case was carefully and clearly argued and his analysis, in my view, is without flaw”. Max is ranked as a Rising Star in Construction by The Legal 500.
As junior counsel, Max’s recent instructions include acting in the first TCC case to consider whether an adjudicator has jurisdiction to determine a Defective Premises Act 1972 claim (BDW v Ardmore), a significant case on building liability orders and information orders under the Building Safety Act 2022 (BDW v Ardmore), two of The Lawyer’s Top 20 Cases of the year, a number of fire safety claims, a PFI dispute, and arbitrations relating to infrastructure and energy projects.
Max is regularly instructed as sole counsel. Recent instructions include appearing for the successful parties in two Part 8 claims in the TCC (MY Contracts v 74 Hamilton and Grove v Bagshot), and representing Transport for London in a successful High Court strike out application (Houston v Transport for London).
Max is co-editor of the TECBAR Review, won the SCL Hudson Prize, and has been published in the International Construction Law Review. Max ranked 1st in his year at law school, having graduated from Cambridge University with a starred double first.

Max has also drafted advice on numerous procedural and commercial, company and contract law matters, including: bonds and guarantees; contractual interpretation of various insurance policies; retention of title in goods and s25 of the Sale of Goods Act; and injunctive relief.
