The 3rd supplement to the 13th Hudson’s Building and Engineering Contracts is now available to order. Hudson’s is regarded by many as the seminal textbook on Construction Law. The 13th Edition, edited by Nicholas Dennys QC and Robert Clay, provides a comprehensive update on the law and interpretation of construction contracts, and was brought up-to-date by a panel comprising of many of the leading practitioners at Atkin Chambers.
About the 3rd supplement, editor Robert Clay noted:
“It includes various House of Lords cases which change the general law in matters relevant to construction contracts. Also included are the interesting Court of Appeal decision North Midland Building v Cyden Homes Limited which may indicate a move towards upholding harshly worded delay and damages provisions, even if they offend against the principle that one party to a contract cannot rely on his own breach of that contract.
The important Court of Appeal decision on adjudication and payment provisions – Grove Developments v S & T (UK) Ltd – is also an important addition as a decision that may have a considerable practical impact on cashflow and the extent to which the paying party may almost immediately reopen issues on interim certificates which have already been paid.
