One Hyde Park v Laing O’Rourke Construction South Limited
One of the Candy Brothers’ most famous developments, One Hyde Park, is at the centre of the dispute. The complaint is that some of the buildings’ mechanical, electrical and plumbing works are defective. Now, One Hyde Park Limited (OHP), as the freehold owner of and the management company for the buildings, seeks damages from Laing O’Rourke Construction South Limited in relation to work it carried out when designing and constructing the MEP system on this prize development.
The trial, set for the end of February 2025, will grapple with a difficult issue concerning whether the Claimant can recover the losses claimed, or if damages should be claimed by the ultra-high-net-worth individuals with apartments in One Hyde Park themselves. The trial is also set to consider the extent of recoverable damages in circumstances where Laing O’Rourke has offered to do the remedial work itself. It is expected that the repercussions of the suit for recoverable damages will be watched keenly by the construction world.
