Shourav Lahiri is a specialist construction and international arbitration lawyer with over 20 years of experience advising on energy and infrastructure disputes.

He represents clients in the onshore and offshore oil & gas, petrochemicals, power, infrastructure and building sectors on the procurement, design, engineering and construction of major projects. He has also represented Asian companies in investigations and sanctions proceedings brought by the World Bank.

Shourav has practised law in Hong Kong, Singapore, London, Dubai and Beijing. He has appeared as counsel in court, arbitrations and mediations in Asia-Pacific, the Gulf States and Europe. In addition to England and Wales, he is qualified to practice in Hong Kong and has full rights of audience in the courts of Singapore and the Dubai International Financial Centre.

He is a Fellow of the Singapore Institute of Arbitrators, on the panel of arbitrators of DIAC and BANI (Indonesia’s National Arbitration Centre) and on the Advisory Council of the Nani Palkhivala Arbitration Centre’s New Delhi centre.

  • Acting for the project owner in a USD 90 million ICC arbitration arising out of a FIDIC Yellow Book design-and-build contract for a 626 km electrified freight rail corridor in South Asia, defending claims for prolongation costs in respect of delays to completion of a section of the project.
  • Acting for the contractor in three arbitrations exceeding USD 43 million in relation to adjacent packages of a FIDIC Yellow Book design-and-build contract for a 137.45 km electrified railway in South Asia, with issues on availability of unencumbered land, removal of utilities, and the construction of per-km/per-day compensation limits for delayed handover.
  • Acting for the highway concessionaire in a USD 5 billion arbitration seat arising out of the termination of a concession for a 135km highway in South Asia due to delays arising from a change in the scope of work.
  • Acting for the contractor in a USD 25 million London-seated arbitration arising out of the termination of a signalling and telecommunications contract on a freight railway project in South Asia, involving issues on lawfulness of termination, exclusion of loss of profit and causes of critical delay to the works.
  • Acting for the claimant contractor in a USD 50 million-plus DIAC arbitration arising out of a FIDIC Red Book contract for the construction of a six-floor car park with roof-level parking and helipad in the Gulf, in relation to claims for variations, prolongation, disruption and acceleration costs.
  • Acting for the respondent project company in a DIAC arbitration in relation to claims of AED 26.7 million for prolongation, disruption and acceleration costs arising from the termination for convenience of a FIDIC Design-Build Turnkey 1995 contract for a school campus in the Gulf.
  • Acting for the claimant subcontractor in an ADCCAC arbitration arising out of a subcontract for civil, structural and fit-out works on a major Gulf infrastructure project, involving issues of back-to-back conditions, the tribunal’s jurisdiction considering parallel proceedings between the same parties, conditions precedent and delay causation.
  • Acting for the claimant contractor in an ICC arbitration arising out of a FIDIC Yellow Book 1999 lump sum contract for debris removal and site reinstatement following the implosion demolition of a development (a Guinness World Record controlled demolition bringing down four high-rise towers in 10 seconds) in the Gulf, under an unusual payment-in-kind structure based on scrap steel recovered from the rubble.
  • Acting for the track work subcontractor in a USD 40 million dispute on the construction of track work for Lines 1 and 2 of a metro rail project in the Gulf, involving mediation and a London-seated arbitration, with issues on access, design changes, variations, free issue materials and approval of handover packages.

  • Acting for the claimant mechanical, electrical and instrumentation subcontractor in a USD 30 million ICC arbitration arising out of a subcontract for the construction of a hazardous waste treatment plant for the refining arm of a Gulf national oil company.
  • Acting for the operator of national oil assets of a North African country in two ICC arbitrations with Paris seat brought by (a) an East Asian contractor, for balance payments on a USD 425 million contract for the construction of a Floating Storage and Offloading vessel and (b) the English PMC contractor for balance payments for services rendered on this project.
