Nicholas Maciolek is a highly experienced advocate specialising in commercial construction, engineering, IT and insurance disputes, both in the courts of England and Wales and in domestic and international arbitration.
Nicholas’ practice includes disputes relating to construction, engineering and infrastructure, energy and utilities, information technology, and professional negligence in both court and arbitration. He has considerable experience with all standard forms of contract commonly relevant to construction and engineering disputes, including all FIDIC contracts, the JCT forms, NEC3 and NEC4, the RIBA professional services contracts, the ACE Partnering terms, as well as many bespoke variations of these forms and standalone bespoke contracts.
Nicholas has recently acted as sole counsel on a EUR 500 million dispute in arbitration concerning delays in the construction and grid connection of a large wind farm in western Europe. His other recent court work involves acting as sole junior counsel in a £25 million dispute concerning the destruction by fire of an apartment block in southern England (and allegations of defects in the remaining blocks), and acting as sole junior in a £60 million dispute concerning Building Safety Act 2022 and Defective Premises Act 1972 claims concerning allegations of endemic defects in a block of student accommodation. His past construction and engineering work has also included disputes concerning oil and gas installations, paving and roadways, electricity generation, airport construction, the construction of medical research facilities, and complex process engineering in the field of can production. In 2021 Nicholas was instructed as sole junior counsel in the leading case concerning liquidated damages in construction cases before the Supreme Court, Triple Point Technology Limited v PTT Public Co Ltd [2021] UKSC 29.
In addition to his construction practice, Nicholas has considerable experience in IT and insurance disputes. He has recently been involved in a series of IT disputes involving complex, long-term projects ending in termination, for instance acting as junior counsel in a £60 million high court claim concerning the termination of a contract for the provision of complex IT services in the pensions industry. He has acted in a number of cases involving broadband and fibre internet network connections. His insurance practice has often involved disputes in the context of construction claims; Nicholas’ experience in both fields and analytic ability allows him to bring novel approaches to claims involving insurers even where no direct coverage dispute arises.
Nicholas has experience of an extensive range of construction disputes, spanning from large and complex engineering projects to residential works contracts. He has worked on disputes over defects, extensions of time, variations, loss and expense, and termination in respect of a range of projects from domestic and commercial construction to energy generation (wind, waste to energy, biomass energy, and nuclear), airport, roads, and railway engineering works. He has also worked on complex process engineering cases (involving canneries and medical research laboratories). Recent examples of his work include:
