Her professional negligence experience is considerable, in particular in matters with a construction context, having often acted for, and against, multidisciplinary firms, architects, engineers, surveyors, project managers and planning professionals, amongst others. Camille also acts and advises in claims against legal professionals, in particular in connection with the conduct of technology and construction disputes.

She is frequently instructed by governments, local governments / government departments, insurers, professionals, developers and construction companies, as well as private individuals, both domestically and internationally. Camille also has experience in a number of high-profile fraud and conspiracy cases in the Chancery Division and Commercial Court.

  • Mears v Costplan and Ors [2019] EWCH Civ 502 (TCC) and (2019) [2019] EWCA Civ 502 (CA) Obtaining a High Court Injunction to prevent the Employer’s Agent certifying practical completion acting for purchaser in an AFL agreement relating to the construction of student housing. Appearing in the Court of Appeal in this leading case on the meaning of “Practical Completion”
  • Keadby Generation v Promanex and others: Acting in multi-party High Court TCC proceedings relation to a fire which destroyed the FGD at Ferrybridge Coal Fire station £70m+ in dispute.
  • Acting for a developer in a dispute concerning the construction yoke mooring system in the Caspian Sea. Sums in dispute €20m+. Bluewater Energy Services BV v Mercon Steel Structures BV and others [2014] 155 Con LR 85.
International Arbitration
  • Acting for the developer in a long running LCIA/DIAC arbitration concerning defects in a glass façade in a luxury multi-use development. Sums in dispute c£250m.
  • Acting for a purchaser in a share purchase / land accusation transaction concerning the purchase and development of a private island in the Seychelles in this multi-national, multi-party LCIA arbitration.
  • Acting for the developer in a dispute concerning the construction of a landmark, ultra-luxury development in the UAE. Sums in dispute c£100m.
  • Acting for a subcontractor in a dispute concerning the construction of a major road in eastern Europe. Sums in c€50m.

Professional Negligence

She has considerable experience in representing claimants, defendants and their indemnity insurers in professional negligence matters. This includes advising on and representing clients in respect of cases relating to allegations of negligence against surveyors, engineers, solicitors, barristers, contract administrators, and architects. Camille has particular expertise in multi-party cases and cases concerning the appointment of professionals under multi-disciplinary appointments. Her experience includes:

  • Leading a team of barristers in Chambers in a TCC claim, acting for a government entity, against a multi-disciplinary construction professional in a dispute regarding a purpose-built operational facility.
  • Acting as lead counsel in a dispute concerning the flagship headquarters of a London borough in a dispute against a design / build contractor. Allegations include design and workmanship defects.
  • Advising and acting in two (unrelated) claims concerning alleged solicitor negligence relating to failures to serve Claim Forms (properly or at all) within the required deadlines.

Energy, Natural Resources & Utilities

Camille has particular expertise in the energy / natural resources sector having been instructed as Counsel in a number of substantial high-value disputes on behalf of major energy companies. Her experience includes:

  • Acting for the main contractor in a dispute concerning the construction of the offshore element of a substantial desalination plant in the middle east. Sums in dispute c$45m.
  • Acting for the civil works contractor in a dispute with the master developer in a dispute concerning the construction of a combined cycle power and desalination part. Sus in dispute c$55m.
  • Acting in an international oil and gas arbitration, conducted under the auspices of the LCIA, which concerned a marine oil extraction facility. (US).
  • Acting in an arbitration concerning design and construction defects in a land-based oil extraction facility in the Middle East.

Building Safety

Camille regularly advises upon, and acts for clients in relation to, disputes concerning building safety, in particular, disputes arising under, or by virtue of, the Building Safety Act 2022, the Defective Premises Act 1972 (as amended), including but not limited to combustible cladding, fire barriers and disputes concerning non-fire related safety defects. Her experience includes:

  • Leading a team of barristers acting for a local authority in connection defects in a social housing development. Defects include fire, structural and M&E defects which compromise the safety of the development. Camille’s client brings a claim against an associated entity for a Building Liability Order.
  • Acting for a residential management company seeking damages in connection with internal and external fire safety defects in a residential development. Defects include those which have been the subject of substantial payments from the Building Safety Fund.
  • Leading a team acting for a supplier in connection with a claim relating to defects in a residential care facility for the elderly. Issues include a dispute about whether the care facility is (or contains) one or more “dwelling house” under the DPA, and the liability of suppliers under the DPA.

PFI

Camille advises and acts for public bodies and contractors in connection with PFI projects, acting in relation to disputes about termination, compliance, levying of service points, quality of delivery etc. Relevant experience includes:

  • Advising and acting in a case concerning a hospital PFI. Disputes included those relating to payment deductions as a result of the allegations regarding defects in the fire protection works at the hospital.
  • Advising a local authority in relation to a PFI project for the construction and maintenance of two schools including an Academy and a Special Educational Needs School constructed on one site. 
  • Acting for Laing O’Rourke in multi-party Part 8 and Part 7 proceedings and generally concerning the design construction and completion of Newcastle Hospital building and maintenance project.   • Ensign Highways v PCC: Acting for Portsmouth County Council in a pre-action disclosure dispute concerning an expert determination in relation to a road upgrade & maintenance PFI project.  Thereafter, advising and representing the Council in an expert determination and underlying dispute concerning service level issues and alleged breaches of good faith obligations.  

Adjudication

Camille’s adjudication experience includes advising on the enforcement of awards and attending summary judgement hearings both to enforce and resist the enforcement of adjudicator’s decision. As well as her enforcement experience, she has significant experience conducting adjudications including attending hearings before adjudicators. Her experience includes:

  • Acting for the respondent in a series of significant adjudications relating to the Manchester Metrolink system upgrade and extension project. (See [2013] All ER (D) 41 (Jan) for related proceedings in which Camille was also involved).
  • Acting as counsel in a series of adjudications in a dispute concerning the Crossrail Project.
  • Successfully resisting the enforcement of an adjudication decision on the bases of alleged breaches of jurisdiction and natural justice.
  • Successfully resisting the enforcement of an adjudication decision where the dispute arose under more than one contract.

General Commercial

Camille has experience in a wide range of practice areas, including commercial fraud. Additionally, she has developed considerable experience in insolvency related cases, with a particular focus on insolvency issues arising within a construction context. Her experience includes:

  • Advising upon and conducting injunction / strike our out proceedings in the Companies Court to restrain the publication of a winding up petition against a company with a historical turnover of c£17m.
  • Acting for a purchaser in a share purchase / land accusation transaction concerning the purchase and development of a private island in the Seychelles in this multi-national, multi-party LCIA arbitration.
  • Acting for the seller in a domestic arbitration concerning a land sale transaction which was terminated when the purchasing company was struck off the company register for default and subsequently restored. Issues included allegations of bad faith and issues concerning the proper operation of the Companies Act concerning the consequences of restoration to the register of companies.
  • Acting for a major newspaper in connection with multi-proceedings involving several high-profile media companies against whom allegations of both lawful and unlawful conspiracy were alleged.

Information Technology & Telecommunications

Camille has experience in the information technology and telecommunications field acting for suppliers and contractors in relation to telecommunication systems. Her experience includes:

  • Advising an ongoing involvement on behalf of a well-known mobile telecommunications company in a dispute worth £8m concerning GSM Gateways, licensed operator’s conditions, pre-action disclosure and competition law.
  • Advising in connection with a primary connection point survey / refurbishment contract; her advice was provided on issues of contractual obligations of good faith and confidentiality and the extent of adjudicator’s powers.
