Caitlin Moore has a practice across Chambers’ core practice areas of construction, engineering and infrastructure, energy and natural resources and technology disputes, in both the domestic and international context.

Caitlin has experience of domestic and international work at all stages of arbitration, adjudication and litigation. Her work has involved a range of bespoke and standard form contracts including, JCT, NEC, RIBA and FIDIC standard forms, in addition to experience with PFI contracts.

Caitlin graduated from the University of Cambridge with a First-Class law degree and has a Master of Laws in International Commercial Law (Distinction) from University College London. She was awarded the Lord Mansfield Scholarship, Lincoln’s Inn most prestigious award to study for the Bar of England and Wales

Expertise

Construction, Engineering & Infrastructure

Caitlin has worked on a range of technically complex and high value construction and engineering disputes. She is familiar with bespoke and standard form construction contracts, including JCT, NEC and FIDIC standard forms. Recent work during pupillage includes:

  • Rail Infrastructure Project, UK: Drafting a Claim Form and Particulars of Claim in a claim concerning a joint venture’s entitlement to payment of inflation on its staff rates under an amended NEC3 Contract, in relation to a major high speed rail project in the UK.
  • Hotel and Casino Resort, Europe: Assisting with the drafting of a Statement of Case on behalf of a Main Contractor in its delay and disruption claims against its employer, in connection with the construction of a hotel-casino resort in the Mediterranean with a total contract value of over €250,000,000.
  • Zinc Roof Defects, UK: Drafting advice for a residential development group of companies, in relation to potential claims against parties involved with the design and construction of a zinc roof at a residential development in London. The potential claims included, inter alia, claims under the Defective Premises Act 1972, Building Safety Act 2022, Third Parties (Rights against Insurers) Act 2010 and the Civil Liability (Contribution) Act 1978.
  • Methyl Methacrylate Production Plant, UK: Drafting advice for an employer concerning disputes arising out of an upgrade project at a methyl methacrylate production plant. The disputes concerned, inter alia, a purported settlement, the operation of liquidated damages provisions, alleged “additional works” and issues of deemed acceptance of the works.
  • Grade II Listed Property Redevelopment, UK: Assisting with research on agency, novation, abuse of process and issue estoppel, in a dispute arising out of the redevelopment of one of the largest private residential homes in London.
  • Residential Development, Brunei: Drafting advice on behalf of a sub-contractor, in relation post-termination loss claims arising out of a subcontract for the construction of housing units in a large scale housing development project in Brunei.
  • Fire Safety Defects, UK: Drafting advice for a large-scale housing developer, in respect of potential downstream claims under the Defective Premises Act 1972 concerning defective cladding.
  • Drainage System Defects, UK: Drafting a Defence and Part 18 Request for Further Information on behalf of approved building control inspectors and their insurers, in a complex claim concerning the drainage system at a luxury house renovation project in London.
  • River Defences, UK: Drafting a defence on behalf of consulting engineers in a multi-party claim brought by the Environment Agency, in respect of repairs works to a revetment river wall system in Essex.
  • Cancer Treatment Centre, UK: Drafting advice on the operation of delay liquidated damages provisions in a contract for the provision of a new cancer treatment centre in London.
  • Luxury Flat Renovation, UK: Drafting advice on the merits of loss and expense claims in relation to an amended JCT Contract for the construction of a luxury penthouse flat in London.
  • Foundation Defects, UK: Drafting advice and a Pre-Action Letter of Response in relation to claims concerning defective foundations, arising out of a JCT Contract for the design and construction of a residential development in London.
  • Roof Replacement and Construction, UK: Drafting advice on the operation of the insurance provisions contained in an amended JCT Contract, in relation to fire damage sustained during the replacement and construction of the roof of an office block building.
  • Fire Safety Defects, UK: Drafting Particulars of Claim on behalf of an employer in a complex fire safety defect claim arising out of defective cladding at a high-rise building in the Paddington basin.
  • Landmark Theatre Project, Hong Kong: Assisting with research on contractual limitation periods in relation to a project for the construction of a major new theatre in Hong Kong.
  • Student Accommodation, UK: Assisting with a mediation concerning a defects and fire-safety claim arising out of a project to construct student accommodation in Cornwall.
  • Fire Safety Defects, UK: Drafting advice on the Defective Premises Act 1972, in connection with a claim concerning fire safety defects at a residential and retail development in Buckinghamshire.

Energy & Natural Resources

Caitlin had worked on domestic and international disputes concerning energy and natural resources. Recent work during pupillage includes:

  • Waste to Thermal Energy Treatment Plant, UK: Preparing research notes, drafting skeleton arguments and drafting an application for permission to appeal, in a case concerning a complex long term contract to construct and operate a waste to energy thermal treatment plant in Buckinghamshire. The legal issues addressed included, inter alia, the construction of a profit sharing agreement in a long term PFI style contract, unjust enrichment, issue estoppel and abuse of process.
  • LNG Expansion Project, Middle East: Drafting advice on the operation of risk allocation and ground conditions provisions, contained in a subcontract for the engineering, procurement and construction of a facilities associated with a major LNG expansion project in Qatar.
  • Semi-Submersible Drilling Rig, Middle East and Brazil: Drafting advice on various entitlements to time related losses and liability for defects, in relation to a contract for the construction and turnkey delivery of a semi-submersible drilling rig.
  • Power Station, Ireland: Drafting a Request for Further Information on behalf of a Contractor, in relation to a dispute arising out of a FIDIC Yellow Book Contract for the construction of two open cycle gas turbines at a power station on the island of Ireland.
  • Energy Centre, UK: Drafting advice on the operation of liquidated damages provisions in a bespoke contract for the mechanical and construction works for the development of an energy centre for a district heating network in London.

Arbitration

Caitlin has developed experience in several domestic and international arbitrations during pupillage including:

  • LNG Project, Africa: Assisting with research for an arbitration under the LCIA Rules, concerning a major LNG project, involving ship building projects and a subsea pipeline project, in Mauritania and Senegal.
  • Hospital Operating Theatre Block, Hong Kong: Assisting with issues of expert evidence on the pipework installed during an extension to a hospital in Hong Kong, in an arbitration under the HKIAC Short Form Arbitration Rules.
  • Energy Project, Middle East: Assisting with a CMC for an arbitration under the ICC Rules, concerning expert evidence on issues of STG, SAP and Delay.
  • LNG Expansion Project, Middle East: Preparing research notes and assisting with the chronology in relation to an ICC arbitration, concerning disputes arising out of a subcontract for the engineering, procurement and construction of a facilities associated with a major LNG expansion project in Qatar.

Adjudication

Caitlin has worked on a number of adjudications during pupillage including:

  • Housing Development, UK: Drafting Adjudicator’s Decisions in relation to a high value adjudication, concerning a bespoke large package agreement for the groundworks, plot works, roads and sewers of a new housing estate in Buckinghamshire.
  • Hospital Project, UK: Drafting an Adjudicator’s Decision in an adjudication concerning claims for non-payment arising out of a contract for construction works at a hospital in the UK.
  • Claims under the Defective Premises Act 1972: Experience with a significant claim concerning whether an adjudicator has jurisdiction to determine a claim under the Defective Premises Act 1972 (BDW Trading v Ardmore Construction [2024] EWHC 3235 (TCC)).
  • Industrial and Distribution Complex, UK: Drafting a Response on behalf of an employer in a ‘true value’ adjudication, concerning claims arising out of a JCT Contract for the design and construction of a large scale industrial and distribution complex in Hampshire.
  • Office and Workspace Complex, UK: Drafting advice on the merits of challenging an adjudicator’s decision, concerning the operation of final account provisions in a contract for demolition and scaffolding works at a newly constructed office and workspace complex in London.
  • Road and Connection Project, Ireland: Drafting a Response on behalf of a contractor against a sub-contractor in a ‘smash-and grab’ adjudication, concerning a NEC3 Contract for the construction of a new road and connections in Ireland.

Commercial Litigation

Caitlin has experienced and assisted on international and domestic commercial disputes at various stages of litigation, in the Technology and Construction Court and the Commercial Court. Recent experience during pupillage includes:

  • Crude Oil Cargoes, Africa: Assisting with research for a trial in the Commercial Court in relation to claims brought by crude oil trader for a range of financing costs initially valued at over $132 million and $5 million, and later revised down to $101 million (Sahara Energy Resource Ltd v Société Nationale de Raffinage S.A. (Sonara) [2024] EWHC 3163 (Comm)).
  • Grade II Listed Property Redevelopment, UK: Assisting with research on service of claim forms pursuant to the Companies Act 2006 and drafting a skeleton argument for an ex parte application for permission to serve on multiple defendants outside of the jurisdiction.
  • Drafting skeleton arguments for various interim applications, including for pre-action disclosure, preliminary issues, enforcement of an adjudicators’ decisions and summary judgment and/or strike out.

Insurance

Caitlin gained experience in a variety of insurance disputes during pupillage including:

  • Mixed Use Development, UK: Drafting advice on the recoverability of losses and insurance policy coverage, in relation to claims concerning the purchase, planning permission approval and redevelopment of a mixed use property in Manchester.
  • New Build Structural Warranty, UK: Drafting advice for an insurer concerning disputes arising out of a new build structural warranty policy of insurance, in relation to a residential apartment block.
