Professor Doug Jones AO is to deliver a public lecture, hosted by the Melbourne Centre for Commercial Law, entitled ‘Common vs civil law: which provides better answers to solving the uncertainties of our times?’

Domestic and international transactions feel the shocks of geopolitical and regional developments in many unpredictable ways, requiring parties’ rights to be adjusted by those impacts.

The common law has long boasted that the certainty that it offers facilitates, indeed demands, its adoption. However, the approach of civil law systems offers a flexibility in the determination of the rights of parties in changing circumstances which challenges the value of the certainties offered by the common law.

Professor Doug Jones AO’s address will examine the urgency of the need for a comparative law analysis to be at the fingertips of transactional and dispute lawyers, whether practising domestically or internationally.
