Jonathan Acton Davis KC, Colin Kangaloo SC and Jennifer Jones KC, instructed by Danielle Inglefield of Fitzwilliam Stone, Furness-Smith & Morgan, appeared in the Privy Council on 30 April 2024 in the matter of Estate Management and Business Development Company Ltd v Junior Sammy Contractors Ltd, which was on appeal from the Court of Appeal of the Republic of Trinidad and Tobago.

The appeal concerned a contract entered into on the FIDIC form about large scale infrastructure works in Trinidad.

The Board was asked to consider:

  1. whether or not issues of abatement or fraud could be pursued against the contractor in light of the pleaded case;
  2. whether or not the employer was entitled to specific disclosure of project documentation in circumstances where it was unable to plead fully in the absence of the same; and
  3. whether or not the claimant contractor had assigned away its right to bring its claim.
