On Monday 13th November, Fiona Parkin KC spoke at a panel discussion, hosted by CMS MENA, as part of Dubai Arbitration Week.
The session was titled ‘Navigating the high-stakes terrain of construction arbitrations: issues of non-payment and insolvency’ and Fiona spoke alongside Sean Yates of Outer Temple, Marcus Antoine Khoury of ALEC Engineering and Ali Ismael Al Zarooni of Horizons & Co. The session was moderated by Greg Sibbald of CMS.
The panel discussed topics including how to deal with non-payment and risks of insolvency during the construction project phase, the remedies available in the early stages of arbitration where an opponent looks like it could be at risk of insolvency or intends to dissipate assets, the implications on a construction arbitration where a party becomes insolvent, as well as issues arising on enforcement.
