Sir Robert Akenhead gave the tribunal’s view at a Navigant hosted evening seminar debating “the thorny issues of disruption claims” on 9 March.
Disruption – and associated productivity losses – remains a notoriously difficult claim to quantify. Whilst disruption will often comprise a significant element of a contractor’s claims on major international construction and engineering projects, it remains an area that arguably lacks guidance, whether legal and/or technical, in circumstances where the evidence is often challenging.
