Construction and Engineering
He has knowledge of standard form building contracts (JCT, ICE), experience in claims for delay and disruption, variations, defects and liquidated damages and advises on issues of contractual interpretation, limitation, exclusion clauses and contract formation.
Been involved in an ICC arbitration in relation to a major energy project in the Middle East
Represented an M&E subcontractor in a variations claim against its main contractor
Been instructed in relation to a residential building dispute, for which he successfully negotiated a pre-trial settlement.
Advised and drafted particulars in a commercial dispute involving misrepresentations.
Represented the defendant in a claim for an unpaid professional services commission.
Rónán is also familiar with the NEC 3 form of contract.
Professional Negligence
He has experience of negligence claims against engineers, architects, contractors and their advisers. This includes involvement in a Court of Appeal case concerning a solicitor's negligence.
He is familiar with RIBA standard forms and architectural design responsibilities.
Advised an employer in a claim against its structural engineer in respect of a leisure development.
Drafted pleadings in relation to the design negligence of architects and engineers.
Housing Grants, Construction and Regeneration Act 1996
He is familiar with all aspects of adjudication, including drafting statements of claim for adjudication proceedings and enforcing or challenging an adjudicator's decision.
Bonds and Guarantees
He has experience making claims under performance bonds and restraining a call upon a demand bond.
Recently advised an employer on how to terminate its contract with an insolvent contractor yet still make a call on a Perar-style performance bond.
