Practice

Jennifer has developed a wide ranging practice with experience in domestic courts (in particular the TCC) and of mediation, adjudication and arbitration. While her main areas of specialisation are construction and engineering, energy and professional negligence, she also has valuable experience in jurisdictional and sale of goods disputes.

 

 

Construction and engineering

Jennifer has acted for contractors and subcontractors, employers and their professional advisers in disputes arising from the design and construction of a wide range of building and civil engineering projects, including process plant and commercial and residential properties. She has expertise in issues relating to loss and expense, delay and disruption, defects, design, delay, diminution in value and quantum meruit claims. She is also familiar with Standard Form contracts (including the JCT, ICE, RIBA, GC/Works and ACE standard forms). Her experience includes:

 

Representing a subcontractor involved in disputes arising from and relating to the construction of a sports stadium and in particular dealing with a large adjudication brought against the subcontractor.

 

Advising and acting for steel fabricators in a delay and disruption claim, relating to the construction of 2 hospices and the headquarters of a large charity.

 

Acting for a manufacturer of power generation equipment in relation to a claim made in respect of an escape of diesel from that equipment at a shopping centre.

 

Representing the employer in a claim intended to be heard in the Bahamian courts, relating to defects in the construction of a local property.

 

Acting for various employers, contractors and sub-contractors in relation to commercial and residential defects, design, delay and diminution in value claims.

 

Advising an employer on amendments to a standard form JCT contract to reflect its requirements when developing a substantial hotel.

 

Energy

 

She has been involved in a number of cases for purchasers and contractors arising out of issues with off shore installations and power stations. Cases include:

 

Acting for the design and build contractor in an international arbitration relating to the construction of a power plant in the UAE, between French and German companies.

 

Acting for the buyer of 2 jack-up oil rigs for the North Sea.

 

Professional Negligence

 

Jennifer has experience of dealing with a variety of professional negligence claims involving a wide range of professionals and consultants in the construction and engineering sector, including architects, engineers, and contractors. Her recent experience includes:

 

 

Acting for the architects employed to design a local authority school.

 

Acting for a public school in relation to defective heating design works carried out at the school.

 

General Commercial

 

Jennifer has also acted in a range of general commercial disputes including:

 

Acting for the appellant in an appeal from an award made by the ECITB.

 

Representing a French company challenging the jurisdiction of the English Courts on the basis of its standard terms.

 

Advising on the construction of bonds and guarantees and on recovery thereunder.

 

Advising on the construction of insurance policies.
