Summary

 

Experience gained at Atkin Chambers

 

While at Atkin Chambers Andrew has gained experience in advising and drafting pleadings in all aspects of Chambers' work. This includes work in the following areas:


Construction and engineering disputes

 

He has general experience of a range of construction disputes, domestic and international, including delay and disruption claims, extension of time claims, variations and defects claims. He is familiar with Standard Form Contracts (JCT, ICE and ACE).

 

He has advised and drafted submissions in relation to procedural matters, such as an application for security for costs, summary judgment, jurisdiction under the Brussels Convention and interim injunctions. He recently took a leading role in the disclosure and inspection stage of a large arbitration.

 

Contract

 

He has experience of a wide range of contractual claims concerning the construction of standard form and bespoke contracts, deeds of assignment and performance bonds.

 

He has advised on contract/no contract issues, exclusion/limitation clauses and the incorporation of standard terms and conditions into a construction contract.

 

Professional negligence

 

He has experience of negligence claims against engineers, contractors and architects and their advisers. This includes appearing in the Court of Appeal in relation to a negligence claim against a solicitor

 

Arbitration

 

He has experience of both domestic and international arbitrations and is familiar with the provisions of the Arbitration Act 1996 and disputes over the jurisdiction of the Arbitrator.

 

Housing Grants, Construction and Regeneration Act 1996

 

He has experience of adjudication under the HGCRA and has assisted in drafting the response to a significant claim.

 

Experience of jurisdictional challenges and issues, including the width of the referral, the meaning of dispute', and whether a dispute had crystallised.

 

Assisted in the drafting of HHJ Coulson's recent publication on the HGCRA and Adjudication.

 

Information Technology

 

He has experience of a dispute involving defective software.

 

PFI

 

He has experience of a dispute under a PFI agreement in the education sector.

 

Party Wall Act

 

He is familiar with the provisions of the Party Wall Act 1996 and disputes involving party walls.
