ARBITRATION EXPERIENCE

 

Domestic

 

Represented parties in a wide range of arbitrations under CIMAR, the ICE procedure, the JCT Rules and ad hoc references.

 

Appeared before inspectors on a variety of town and country planning appeals, primarily involving housing projects. Provided advice connection with a substantial urban development, with particular regard to section 38 and section 106 agreements.

 

International

 

Currently sitting as a party-appointed arbitrator on an ICC panel hearing a complex dispute between a Spanish sub-contractor and a German contractor involving a Caribbean electricity supply system. English law applies. Previously represented Caribbean resort owners on the enforcement in England of an LCIA award.

Recently acted for Italian sub-contractors in an ICC arbitration involving substantial claims concerning a gas pipeline in the Gulf of Arablia. Previously represented Eastern European clients in significant oil related disputes before an ICC tribunal in London.

 

Moderated at Chartered Institute of Arbitrators' European Branch meetings at which various Eastern European and Russian Federation States have been represented. Has spoken at various meetings in Vilnius, Lithuania, Riga, Latvia, Timisoara, Romania and Stockholm, Sweden.

 

Currently acting as counsel for an American heavy earth-moving equipment supplier in a Swiss Rules arbitration regarding a large canal in Pakistan. Swiss law applies. Previously advised Pakistani highway authorities regarding disputes with a Turkish engineering contractor.

 

Represented a Maltese sub-contractor in proceedings against an Italian joint venture involving a substantial hospital project. Maltese law applied before an UNCITRAL tribunal in London.

 

Acted in ICC arbitration for contractors claiming against an Egyptian financial institution in respect of the construction of a 30 storey office building in Cairo. After various hearings in Paris and several awards, substantial recovery was achieved. English law applied.

 

Represented American employer in London ICC arbitration concerning the supply of medical goods by a Scandinavian company. Dispute resolved by negotiation.

 

Shipbuilding

 

Represented the local authority owners of two ferries the subject-matter of a refurbishment contract. Advised Dutch shipbuilders on the terms of a proposed vessel refurbishment contract.
